'He created the original sin: an investigation of no crime.'


Former federal prosecutor Joe diGenova said Deputy Attorney General Rod Rosenstein has "disqualified" himself from continued service with the Department of Justice.

Members of the conservative House Freedom Caucus have drafted articles of impeachment against Rosenstein, calling it a “last resort” if the Justice Department continues “slow-walking” its response to document requests related to the Russia investigation.

Speaking at an event in Washington on Tuesday, Rosenstein accused caucus members of not being able to “resist leaking their own draft,” adding that DOJ “will not be extorted.”

On "Tucker Carlson Tonight," diGenova said Attorney General Jeff Sessions should berate Rosenstein for comparing Congress' constitutional right of oversight to extortion.

"That statement by a constitutional officer like Rod Rosenstein is disgraceful, it's an embarrassment to the department," diGenova said. "But it is of a pattern of what Mr. Rosenstein has done there since he arrived."

He pointed out that Rosenstein was the one who appointed Special Counsel Robert Mueller and the one who's overseeing the Russia investigation, which Trump has long labeled a "witch hunt."

"He is resisting all of this because he created the original sin: an investigation of no crime," diGenova said, slamming Rosenstein as an "unaccountable bureaucrat."

Declassified Congressional Report: James Clapper Lied About Dossier Leaks To CNN


 
A newly declassified report on Russian interference in the 2016 U.S. elections reveals that former intelligence chief James Clapper lied to Congress about information he shared with CNN on the infamous Steele dossier.
 

Buried within a newly declassified congressional report on Russian meddling in the 2016 U.S. elections is a shocking revelation: former Director of National Intelligence (DNI) James Clapper not only leaked information about the infamous Steele dossier and high-level government briefings about it to CNN, he also may have lied to Congress about the matter.

In one of the findings within the 253-page report, the House intelligence committee wrote that Clapper leaked details of a dossier briefing given to then-President-elect Donald Trump to CNN’s Jake Tapper, lied to Congress about the leak, and was rewarded with a CNN contract a few months later.

“Clapper flatly denied ‘discussing[ing] the dossier [compiled by Steele] or any other intelligence related to Russia hacking of the 2016 election with journalists,'” the committee found.

When asked directly whether he had ever discussed the dossier with any journalists, Clapper replied that he had not, according to a transcript of the proceedings:

MR. ROONEY: Did you discuss the dossier or any other intelligence related to Russia hacking of the 2016 election with journalists?

MR. CLAPPER: No.

The former DNI later changed his story after he was confronted specifically about his communications with Jake Tapper of CNN.

“Clapper subsequently acknowledged discussing the ‘dossier with CNN journalist Jake Tapper,’ and admitted that he might have spoken with other journalists about the same topic,” the report continued. “Clapper’s discussion with Tapper took place in early January 2017, around the time IC leaders briefed President Obama and President-elect Trump, on ‘the Christopher Steele information,’ a two-page summary of which was ‘enclosed in’ the highly-classified version of the ICA,” or intelligence community assessment.

The briefing of Trump by U.S. intelligence chiefs was held on January 6. CNN published its story on the briefing, based on anonymous leaks from “two national security officials,” on January 10. BuzzFeed published the full dossier, which was jointly funded by the Hillary Clinton campaign and the Democratic National Committee, minutes after the CNN story was published.

The revelation that Clapper was responsible for leaking details of both the dossier and briefings to two presidents on the matter is significant, because former Federal Bureau of Investigation (FBI) director James Comey wrote in one of four memos that he leaked that the briefing of Trump on salacious and unverified allegations from the dossier was necessary because “CNN had them and were looking for a news hook.”

The congressional report on Russian interference noted that it was this very briefing of Trump that multiple media organizations used as an excuse to publish the unverified dossier.

“The Committee assesses that leaks to CNN about the dossier were especially significant, since CNN’s report ‘ that a two-page synopsis of the report was given to President Obama and Trump’ was the proximate cause of BuzzFeed News’ decision to publish the dossier for the first time just a few hours later,” the report stated. “Until that point, the dossier had been ‘circulating among elected official, intelligence agents, and journalists,’ but remained unpublished. As the accompanying article explained, ‘[n]ow BuzzFeed News is publishing the full document so that Americans can make up their own minds about allegations about the president-elect that have circulated at the highest levels of government.”

As The Federalist‘s Mollie Hemingway noted after Comey’s memos were finally made available to the public, the fired FBI director’s account of the briefing of Trump suggested that the entire briefing was a setup from the beginning, and that it was scheduled and held just so it could be leaked to journalists who wanted an excuse to publish a dossier nobody had verified.

In their coordinated response to the full intelligence committee’s findings, committee Democrats defended Clapper, claiming that he broke no laws while acknowledging that he did leak information about the dossier to CNN’s Jake Tapper.

“Evaluated in context, Clapper denied leaking classified information, while acknowledging that, as DNI, he engaged in legitimate discussion of unclassified, non-intelligence information with Tapper,” they concluded.

Clapper, who previously lied to Congress about whether the U.S. government was electronically spying on millions of Americans, was subsequently hired by CNN just months after his leak. Although he eventually apologized to Sen. Dianne Feinstein (D-Calif.) for lying to Congress about government mass surveillance of American citizens, he subsequently told MSNBC that the question to which he responded–“Does the NSA collect any type of data at all on millions or hundreds of millions of Americans?”–was a gotcha question similar to, “When did you stop beating your wife?”

The already steaming political world is only getting hotter. Sunday on Fox News, Rep. Devin Nunes dropped a bombshell during an interview with Maria Bartiromo.

“We now know that there was no official intelligence that was used to start this investigation. We know that Sidney Blumenthal and others were pushing information into the State Department. So we’re trying to piece all that together and that’s why we continue to look at the State Department,” Nunes said.

Nunes continued, “This is really important to us because the intelligence investigation uses the tools of our intelligence services that are not supposed to be used on American citizens.

He then went after the Obama DOJ, “So, we’ve long wanted to know what intelligence did you have that actually led to this investigation. So what we found now after the investigators have reviewed it is in fact there was no intelligence. So we have a traditional partnership with what’s called the Five Eyes Agreement…”

Maria Bartiromo followed up to his comments, “Mr. Chairman you’ve got to explain what you just said. I think this is extraordinary. That you’re telling us that in order for the FBI, the Department of Justice to launch an investigation into so-called collusion between President Trump and the Russians there was no official intelligence used. Video: DiGenova on Memos: 'Comey Should Go to Prison'

Former U.S. Attorney for D.C. and chief counsel to the Senate Rules Committee Joe diGenova stated on WMAL radio on Friday that the memos written by then-FBI Director James Comey about his conversations with President Donald Trump early in 2017 reveal a "tortured and troubled mind," a man who "committed a crime" and who "should go to prison."

DiGenova, a long-time attorney dealing with white-collar crime and congressional investigations, also said that the memos reminded him of those written by Nazi war criminals, who detailed their illegal actions in documents and then saw those same documents used against them during the Nuremberg trials.

DiGenova added that the Comey memos further confirm that top people in the Justice Department (DOJ), the FBI, and the Obama administration were involved in "a brazen plot to exonerate Hillary Clinton, and then if she lost the election, to frame Donald Trump."

During the April 20 interview on WMAL's "Mornings on the Mall," co-host Mary Walter talked about the DOJ Inspector General's criminal referral of former FBI Deputy Director Andrew McCabe, who made false statements, "lacked candor," on four occasions when being interviewed by FBI officials. Was this surprising to you? she asked diGenova. 

“It’s not a surprise and here’s the reason why," said diGenova. "What you are watching is the Department of Justice clumsily get back to a rule of law with one standard, instead of the two standards that were applied during the Obama administration."

"The referral of Mr. McCabe for possible prosecution … is an example of the department trying to figure out a way to restore its credibility and the confidence of the American people in a very broken department that was ruined by Loretta Lynch, Eric Holder, and a bunch of other people at the top and, of course, James Comey," said diGenova.

"So, this is all about if you’re going to charge [former Trump adviser] Michael Flynn, you have to charge Mr. McCabe," he said.  "It’s real simple stuff. And if McCabe isn’t charged, I don’t care if it’s a Republican U.S. attorney or not, these guys are going to pay a price. It’s too bad. This isn’t retributive justice or vengeance. This is the rule of law. This is what it looks like."

He continued, “And for the Democrats who keep saying ‘no there there,’ like that idiot Nancy Pelosi yesterday, who says the memos confirm everything she’s ever said – God help us, what an idiot!"

Given what the memos reveal about why Comey spoke with Trump, diGenova said, "It shows that there was, in fact, a plot, a brazen plot to exonerate Hillary Clinton, and then if she lost the election, to frame Donald Trump. Because what they were doing with the [salacious Russia] dossier was dirtying-up the president so that when the [Christopher] Steele dossier became part of the FISA warrant process, they could use it in the application of public pressure to get a special prosecutor."

"Comey knew that," said diGenova. "That’s why he leaked the memos. Every single thing that Comey and Clapper and Brennan, and the people at the highest levels of the FBI did, and at DOJ did, was to set in motion a set of false facts to warrant an investigation and they got it." (James Clapper was the director of National Intelligence and John Brennan was the CIA director in the Obama administration.)

“Comey should go to prison," said diGenova.  "All this talk about, ‘you can’t lock up an FBI director,’ well, I got news for you, L. Patrick Gray should have went to jail, and these people should go to jail." (L. Patrick Gray was the acting FBI director during Watergate and he destroyed documents.)

Asked to comment further on the Comey memos, diGenova said, “It’s a veritable cornucopia of revelations of a very, very tortured and troubled mind. I urge people to print out the 16 pages – they’re available everywhere on the Internet – and read them."

"What you see is a man – I was saying to Victoria [Toensing], my wife, this morning, as I read them, I thought of the Nazis who kept detailed records of the exterminations and then they were used in the war crimes against them," said diGenova. "This is the same thing. These are the Nazi war crime memos done by an American government official."

"They are a detailed description of how to violate the law, subvert the Constitution, and frame an incoming president of the United States," he said. "They are filled with arrogance, and I must say, the writings of what I consider to be a very disturbed mind."

DiGenova was also critical of Deputy Attorney General Rod Rosenstein, who wrote the memo to Trump advising that Comey be fired and who then appointed Robert Mueller to investigate Trump.

“Rod Rosenstein, when all is said and done, will go down in history as an absolute coward for having appointed Robert Mueller," said diGenova. 

"Go back and look at this now, and you see that nothing, nothing has been discovered about collusion," said diGenova.  "[For Rosenstein] to sit there and not tell the president of the United States a long, long, long time ago that he had no [legal] exposure is absolutely despicable by Rosenstein."

"And when this is over – when this is over!" he said, "[Attorney General] Jeff Sessions should fire Mr. Rosenstein ipso facto, as fast as possible."

WMAL co-host Vince Coglianese then asked about these FBI and DOJ officials who are now criticizing each other in public and claiming that other people are not telling the truth, and whether it is all spinning out of control.

“It is, the brazen plot is unraveling," said diGenova.  "It’s also like rats swimming to a sinking ship. These are people who are fundamentally dishonest people. When you watch James Comey on television, you are watching the unraveling of a bad mind. You’re watching a man who engaged in conspiracies, who corruptly tried to frame people, who lied to his superiors, who conspired to leak information."

He continued, "And, when you look at the 16 pages that were released of these memos, you will see that huge portions are blacked out. Now why is that? It’s because the information was determined to be highly classified. That means when James Comey gave those memos, took them out of his house and gave them to the professor at Columbia, Mr. Daniel Richman, he committed a crime."

"You are watching the destruction, the self-destruction, hari-kari of James Comey by his own hand," said diGenova. "It is wonderful to watch. No one deserves it better. This guy is a total scumbag.”

Comey's Memos Reveal How He Repeatedly Lied To Trump

Scandal:
Whatever James Comey's motives were for writing memos about his meetings with President Trump, they reveal how duplicitous the former FBI Director was with the new president.

News of those memos first broke last May, after Comey gave four of the seven he'd written to a friend, who then shared some of the details with the New York Times — details designed to make it appear that Trump was attempting to obstruct justice in the ongoing Russia investigation. Comey later admitted that he leaked the memos in hopes that it would prompt the appointment of a special counsel. Which, of course, it did.

Now, nearly a year later, we finally have the chance to see the complete Comey memos — minus a few redactions. (You can read them here.)

But the picture that emerges most clearly from them is not one of a crazed, deranged Trump trying to obstruct the FBI's investigation into Russian election meddling. If anything, Trump comes across as sympathetic.

Instead, Comey manages by his own hand to show how he repeatedly lied and deceived Trump, and how he purposely withheld information from him knowing full well that by doing so he was hurting Trump's ability to do his job.

Video: Levin: ‘Dammit,’ Trump Can’t Lawfully Be The Target of a Criminal Investigation

Why is no one else making this point?


Appearing on “Hannity” Thursday night, LevinTV host Mark Levin made the one point most of the legal analysts on cable news seem to be ignoring: Under the law, President Donald Trump cannot be the target of a criminal investigation. He also said that the newly released Comey memos do not hurt President Trump and in fact incriminate former FBI Director James Comey.

“These memos actually help the president; there is nothing incriminating in them,” Levin said. “See these redacted areas? They incriminate Comey, because he said he didn’t release classified information. At the bottom of a number of these pages, it says, ‘classified.'”

“So he’s got some ‘splaining to do.”

Turning to the news that last week that Deputy Attorney General Rod Rosenstein reportedly told President Trump that he was not the target of a criminal investigation, Levin argued that under the Department of Justice’s long-standing interpretation of the Constitution, no sitting president can be the target of a criminal investigation.

“Let’s get something straight,” Levin said. Pointing to memorandums from both the Clinton administration and the Nixon administration, Levin read the official position of the DOJ that indicting a U.S. president would unconstitutionally hamper the ability of the executive branch to carry on its Article II functions.

“Page after page after page saying a sitting United States president cannot be indicted,” Levin explained. “Now, my question is this: Did they issue another memo over there at the Justice Department reversing these two memos during the Nixon administration and the Clinton administration? No!”

“Dammit, [Trump] can’t be criminal target,” Levin said.

New Emails Reinforce Claims Of DOJ, FBI Collusion In Clinton Email Investigation

New evidence points to collusion between the Department of Justice and FBI at a pivotal moment in the Hillary Clinton email probe, according to emails recently reviewed by Fox News.

The February 2016 emails were written in the aftermath of 22 messages labeled “Top Secret” having been found on Clinton’s private email server from her 2009-2013 tenure as secretary of state.

In congressional testimony, former FBI Director James Comey dismissed notions of DOJ-FBI coordination during their look into the matter, specifically denying any conspiracy with the Department of Justice in his advisement against pursuing charges in the Clinton case in July of 2016.

By contrast, however, in a letter issued Wednesday, Republican North Carolina Rep. Mark Meadows noted communication that, in his view, designated points of possible collusion at “crucial moments of the investigation.”

The messages examined by Fox began on February 8, 2016, at which time FBI Head of Counterintelligence Bill Priestap was informed by Assistant Secretary of State for Diplomatic Security Gregory Starr that the State Department was ready to bring to justice those responsible for the reckless care of top secret information. Starr wrote, “The Department of State is prepared to take appropriate action for any instances of mishandling of classified information in accordance with our own internal processes.”

Starr made clear his wish to not hamper the FBI’s continuing inquiry, adding that — if directed — he would postpone any “administrative action” until the conclusion of the bureau’s case.

On February 13th — five days later — FBI criminal division and Office of General Counsel member Jonathan Moffa, FBI agent Peter Strzok and constituents of the U.S. Attorney’s office for the Eastern District of Virginia received a message from an unnamed senior official at the DOJ’s National Security Division, saying, “Wanted to make sure that DOJ is kept in the loop as response is drafted. We have discussed a bit more here at CES [counterintelligence and export control section] and have some additional thoughts on the best response on the admin action question. Can we make sure we discuss as a group as response is put together?”

Ultimately, the State Department declined to take action regarding the 22 security-sensitive Clinton emails. By the time the FBI review was over in July of 2016, several key players at the State Department had resigned.

On Wednesday, Attorney General Jeff Sessions, Deputy Attorney General Rod Rosenstein, Justice Department Inspector General Michael Horowitz and FBI Director Christopher Wray were petitioned by Republican South Carolina Rep. Trey Gowdy to review the allegations of coordination between the DOJ and the FBI in the Clinton probe.

Comey Memos Puncture Collusion and Obstruction Narratives

Congress received the memos from former FBI Director James Comey on his meetings with President Donald Trump. What I found interesting is what is not in the memos: Evidence of collusion or an attempt to obstruct the FBI.

Loyalty

The first meeting between the men happened on January 6, 2017. In that meeting, Comey told Trump that “the Russians allegedly had tapes involving him and prostitutes at the Presidential Suite at the Ritz Carlton in Moscow from about 2013.” You know, the infamous “golden showers” portion of the dossier. Trump replied that “there were no prostitutes, there were never prostitutes.”

Comey told Trump that media outlets like CNN and others had the information, but that “it was important that we not give them an excuse to write that the FBI has the material or” something else that is blacked out. He told Trump that the FBI was “keeping it very close-hold.”

Well, after that meeting, the dossier appeared at BuzzFeed and that the intelligence community told Trump about these allegations.

This leads us to the next meeting when Comey dined with Trump at the White House on January 28, 2017. The two men discussed leaks and Comey wrote that Trump like other presidents “would discover the entire government leaks like crazy and explained that it often comes from the first or second hop out from those actually working on the sensitive thing.”

Trump told Comey “that he needed loyalty and expected loyalty.”

Okay, so after this came out, everyone immediately said that Trump demanded loyalty from Comey. But from the sound of it, Trump meant from everyone that surrounds him. It sounds like he doesn’t want leaks to happen and protect sensitive information. Byron York explained at The Washington Examiner:

Why would Trump wonder about the FBI director’s loyalty? Perhaps because in their first meeting, the FBI director dropped the Moscow sex allegation on Trump, followed immediately by its publication in the media. It seems entirely reasonable for a president to wonder what was going on and whether the FBI director was loyal, not to the president personally, but to the confidentiality that is required in his role as head of the nation’s chief investigative agency.

A few more things. We had known earlier that Comey briefed Trump about the dossier one-on-one on January 6, 2017. But it was not until an interview Thursday with CNN’s Jake Tapper that Comey revealed the conversation was only about the Moscow sex allegation. The other parts of the dossier — about Paul Manafort, Michael Cohen, allegations of collusion — Comey did not mention to the president-elect. No wonder Trump associated the dossier with the Moscow sex story.

York also mentioned that the media couldn’t believe that Trump obsessed over the supposed incident in Moscow. Now we know that is the only subject Comey briefed him on in the very first meeting. If Comey told him all about the dossier and Trump only concentrated on that hotel room incident then yes, he was obsessive. But Comey only spoke about the “golden showers.”

At the dinner, Comey wrote that Trump “thought very highly of” him, but “would understand if” he wanted to walk away. Comey said he enjoyed his job. Later on, Trump told Comey he was glad that Comey wanted to stay and heard great things about him. Trump also reiterated that he “wanted competence and independence and didn’t want the FBI involved in policy.”

Trump then said he wanted “honest loyalty” and Comey replied that he would “get that from me.” Comey even admitted in the memo that it’s quite “possible we understood that phrase differently, but I chose to understand it as consistent with what I had said throughout the conversation: I will serve the President with loyalty to the office, the country, and the truth.”

Again, it doesn’t sound like Trump wanted Comey to do as the president wanted or said. It sounds like he wanted the FBI to do what it’s meant to do.
