Pennsylvania Court Drops Bombshell Ruling: Digital Images of Completed Absentee and Mail-In Ballots are Public Records

In a landmark decision, the Commonwealth Court of Pennsylvania has ruled that digital images of completed absentee and mail-in ballots are to be considered public records.

This pivotal ruling stems from a case involving appellant Michelle Previte, who sought to obtain electronic copies of these ballots from the 2020 General Election via Pennsylvania’s Right-to-Know Law (RTKL).

The case began when Previte submitted RTKL requests to the Erie County Board of Elections, seeking access to digital images of all mail-in and absentee ballots, as well as images of the outer envelopes and polling place ballots from the November 2020 election.

A contentious legal battle over election integrity in Arizona has intensified following a recent ruling by the Ninth Circuit Court of Appeals. 

On August 1, a three-judge panel of the Ninth Circuit overturned a prior decision that required proof of citizenship to vote in federal elections. This ruling, which was decided in a narrow 2-1 vote, now allows individuals to register to vote using a state form, without having to provide citizenship documentation for federal positions such as President and Congress.

Texas Judge Overturns City Council Election Due to Voter Fraud and Allegations of Fake Addresses on Voter Registrations

A visiting judge has overturned the results of the November 2023 Edinburg City Council election, declaring Gerardo “Gerry” Lozano the rightful winner over incumbent David White, myRGV.com reported.

The lawsuit, brought forward by challenger Gerardo “Gerry” Lozano, contested the narrow victory of incumbent David White, alleging widespread irregularities, including illegal assistance to voters and the use of fake addresses in voter registrations.

The central issue in Lozano’s suit involved allegations against ‘politiqueras’, paid campaign workers accused of illegally aiding voters both in-person and through mail-in ballots. Some accusations extended to voters allegedly using fake addresses on their voter registrations.

The court’s findings revealed that these politiqueras assisted numerous voters who did not meet the legal criteria for such help. According to myRGV, citing Texas Election Code, assistance at the polls is strictly reserved for voters who are either illiterate or physically incapable of filling out ballots on their own. This assistance can extend to physically disabled voters eligible for curbside voting.

In a landmark decision, a Bexar County visiting judge has ordered a new election for the 180th District Court seat in Harris County, Texas. This ruling comes after Republican candidate Tami Pierce narrowly lost to Democrat DaSean Jones by a mere 449 votes in the November 2022 election.

DaSean Jones, who was sworn in as a Harris County criminal district court judge 15 months ago and has since presided over hundreds of cases, now faces uncertainty about his 2022 election victory.

Republican Tami Pierce continues to contest the election results in court, asserting that “improper or illegal votes were counted” and that the election was “riddled with errors.”

NYC’s Non-Citizen Voting Law Struck Down by Appeals Court

New York City's law that lets non-citizens vote in local elections hit a brick wall on Wednesday, as a state appeals court ruled it violates the state's constitution. Approved in Dec. 2021 by a 33-14 city council vote, the controversial law had not yet been put into practice, owing to an injunction imposed in 2022 by a lower court on Staten Island.  

“We determine that this local law was enacted in violation of the New York State Constitution and Municipal Home Rule Law, and thus, must be declared null and void,” wrote Appellate Judge Paul Wooten in the 43-page ruling.

The measure would have allowed approximately 800,000 non-citizens to vote in city elections. The law limited that new privilege to permanent legal residents of the United States, and those with federal work authorization. Republican party officials quickly sued, arguing the city was acting beyond its authority. On Wednesday, the New York appeals court upheld the 2022 ruling.

Mercer County, NJ Residents File Lawsuit Against Election Officials Over Voter Disenfranchisement

Dominion Voting Systems Error Rendered All Tabulators Inoperable on Election Day

Ten residents of Mercer County, New Jersey, have taken their grievances to the Superior Court, alleging severe voter disenfranchisement due to a series of errors linked to Dominion Voting Systems and the handling of the 2022 and 2023 elections.

On February 14th, the group lodged a hefty 360-page complaint, laden with evidence, detailing the systematic failures that stripped them of their fundamental voting rights.

The complaint, accessible at Wefer Law Offices, exposes the extent of the mishaps that occurred during the recent elections.

The lawsuit highlights that in 2022, a crucial technical error by Dominion Voting Systems rendered all tabulators inoperable when they failed to update ballot IDs after the County made changes to the ballot layout. This significant oversight was initially kept from the public by County officials and only surfaced following public insistence on an explanatory hearing.

First Circuit Court of Appeals Rules Voter Rolls are Public Records and Election Officials Cannot Hide Them from the Public

MONUMENTAL RULING FOR ELECTION INTEGRITY

The Public Interest Legal Foundation secured a landmark case on Monday in the First Circuit Court of Appeals.

The Court ruled that under the National Voter Registration Act of 1993 (NVRA) Maine’s voter roll is a public record and election officials cannot hide the information from the public.

“Whether voter registration rolls are accurate and current cannot be determined without inspecting the Voter File…In other words, the evaluation of voter registration rolls would be impossible if the results of Maine’s voter list registration and maintenance activities were not subject to public disclosure. For the above reasons, Maine’s Voter File is a record concerning the implementation of programs and activities conducted for the purpose of ensuring the accuracy and currency of official lists of eligible voters and is thus subject to disclosure under Section 8.”
